  8. when is said there is no "right to privacy" in a previous post, i meant only that it is not specifically delineated and that is the originalist argument those three justices will no doubt write about. one can quibble whether the right to be free of unreasonable searches and seizures on one's person confers a general right to be able to do whatever one wants with one's body wherever one wants to do it. not to mention whether it means you have the right to kill the other human body growing inside you. the right to bear arms is clearly stated in the constitution, the question there has to do with the interpretation of the introductory clause. and despite what you will read here, it is far from clear that the clause has a limiting purpose on the right. 18th century laws were written with such clauses a lot and not all of them were meant to limit the laws following the introductory sentences. and - not to get off on a tangent here - but the constitution was written in the late 1700s. in a functioning democracy, it would probably have been rewritten by now to reflect more modern ideas.

Zemmour's popularity in France is troubling, but not unexpected. in the end, his presence probably splits the far right vote and sends macron back to the presidency. however, a sensible republican candidate could result in a real four way split in the vote leading to a potentially interesting run off.

  17. 1) the opinion you cite is by Larsen and she is a woman. 2) the majority upholding the ruling was written by a republican judge. darn crazy conservatives. 3) they ruled against holding an en banc hearing so its going up to the supremes on an emergency basis. they upheld previous state laws on covid so we'll see if they do so again. 4) that wasnt really the focus of larsen's opinion. that said, i didnt think it was a really well reasoned opinion.
  18. i think roberts would love to do his usual roberts-ness and tweak the case law without outright overturning it. gorsuch, alito, and thomas would probably overturn it outright by saying there is no "right to privacy" in the constitution (cause there isnt). kavanaugh and barrett are the keys. can the chief persuade them to keep the right to privacy stuff while rolling back what an "undue burden" is? that will be the key to keeping casey on the books.
  19. the "white working class" voted overwhelmingly for donald trump, who is avidly anti-union. support for unions is not what drives the white working class to vote. biden openly marching with union workers would do nothing to help him nationally.
  20. once upon a time on another site that used to exist but is now only for gambling, i would prepare a long post for these seemingly annual epic battles between the cardinals and the lions. back when both were the poster children for the worst franchises in nfl history. bidwell against ford for the title of abject failure in ownership. well no more. now there is only one franchise standing alone in its misery as the worst of the worst. cardinals are -13 in this game. everyone is injured or in covid protocols.

  25. its really bothersome to me. its just seemingly accepted and then were told its no big deal that car jackings are way up or that a bunch of teenagers got together in downtown, wrecked a bunch of shit and then beat the shit out of a bus driver. yes, fox news uses this in racist ways to drum up viewership and scare people. but is the fact that it happened and is happening a lot more frequently suddenly ok? its like the anti-vax shit. people are anti-vax to "own the libs." its like people are pro crime to "own the cons." crime should not be acceptable no matter what. as far as the neighborhood that chas is saying is so safe, i used to live there and i know people that own a business there that is involved in trying to get extra security (which, btw, theyve had in boystown for years and are now getting on michigan avenue) because of recent events. so i tried to point out something because i have first hand knowledge of it. and again, a bunch of people were stopping traffic and parking their cars in the middle of the street every weekend night after 2 am. in one of the busiest intersections in the area. the police identified a number of them as wanted drug dealers. lo and behold, a couple weeks later there is a drive by shooting outside a club that kills one person and injures 4 or 5 more. why wouldnt businesses be concerned? why shouldnt they want extra protection? come on. this is not fascism, its a response to a deadly shooting! meh, no big deal. only one person died.
