We've always been here. Handicapped people were legally deprived an education until the 1975 Education for All Handicapped Children Act. Handicapped people were legally deprived the right to work until the 1990 Americans with Disabilities Act. DEI is actually DEIA - the A being accessibility. Handicapped people are even excluded from the hatred of DEI. 😉6 points

But if the Tigers had offered 25 million, the mid-point becomes 28.5. So, they would have better chance of winning. Offering 19 makes sense if you think that the arbitrator will arrive at a figure between 19 and 25.5. I am assuming that is what they think. Either that, or they underestimated the 32 million figure.2 points

I am getting pretty annoyed at all the heat on Holmes. He built something amazing very quickly here. Had a step-back year. It happens. You don't throw out a GM like that because of a mulligan. The 15-2 season almost everything broke their way. The 9-8 season almost everything different. It really came down to the O-Line losing it's anchor in the middle and having an LT put together with duct tape and a bunch of guys who were pretty green. It's fixable. A 4th place schedule won't hurt either. Everyone need to chill the **** out.2 points

well....that's not ALL i said. lol. i think its true that if she had not likely panicked and followed direction, this would not have happened. if she's not parked in the middle of the road, this doesnt happen. i also think she panicked because the ICE officer was unnecessarily hostile and it scared her. again, its standard police procedure nowadays to NOT stand in front of a vehicle for this very reason. its also pretty standard now to attempt to de-escalate an emotional situation before other methods of coercion are tried. Sometimes it is impossible for the police to get people to follow direction without some use of force. i get that. in fact, i'm on the side of the police 9 times out of 10. and even if i have seen the video, i wasnt there that day and dont know everything that went on. with that said, it certainly appears that the ICE officers intentionally escalated a situation that need not have been escalated. if he goes to her and says "ma'am, i understand your position on our work. i get it. but we are going to need to proceed down this road. i need you to move so we can get through. if you do not move, i may have to arrest you." this was not a 250 pound linebacker. it was not a drugged out psychopath. this was a woman in a car. let's try talking before escalating. that's what police officers are trained to do. but these arent officers. many simply appear to be thugs with guns. that's how its been here in chicago, and that's how it seems to be in minneapolis. to pfife's earlier point, even if charges are brought, trump will pardon him immediately. because he's a federal officer acting on federal orders, federal law will govern and supersede any state law, so i dont think any state criminal action will be valid so trump's inevitable pardon will let him off.2 points

From the DOJ's own guidelines on their website. Now, maybe DOJ law enforcement officials have different training and standards than ICE officials under Homeland Security. But I suspect they would and should align. 1-16.200 - USE OF DEADLY FORCE AND PROHIBITED RESTRAINT TECHNIQUES A. Deadly Force Law enforcement and correctional officers of the Department of Justice may use deadly force only when necessary, that is, when the officer has a reasonable belief that the subject of such force poses an imminent danger of death or serious physical injury to the officer or to another person. Deadly force may not be used solely to prevent the escape of a fleeing suspect. Firearms may not be discharged solely to disable moving vehicles. Specifically, firearms may not be discharged at a moving vehicle unless: (1) a person in the vehicle is threatening the officer or another person with deadly force by means other than the vehicle; or (2) the vehicle is operated in a manner that threatens to cause death or serious physical injury to the officer or others, and no other objectively reasonable means of defense appear to exist, which includes moving out of the path of the vehicle. Firearms may not be discharged from a moving vehicle except in exigent circumstances. In these situations, an officer must have an articulable reason for this use of deadly force. If feasible and if to do so would not increase the danger to the officer or others, a verbal warning to submit to the authority of the officer shall be given prior to the use of deadly force. Warning shots are not permitted outside of the prison context. Officers will be trained in alternative methods and tactics for handling resisting subjects, which must be used when the use of deadly force is not authorized by this policy. Deadly force should not be used against persons whose actions are a threat solely to themselves or property unless an individual poses an imminent danger of death or serious physical injury to the officer or others in close proximity.1 point

Lets be fair here, she was saying that while blocking the road and her partner was outside the vehicle filming and antagonizing. I still think the shooting wasn't justified but it's very clear from this video that the narrative about her being scared and just being there because she had dropped her kids off is nonsense. They were clearly there to impede and antagonize law enforcement and planned on continuing to do so.1 point

I'm trying to dig up the articles, but the studies out there have not really shown any hurt feeling effect for players who went through arbitration. They really just take the best deal they can. Some re-sign, but not any less than those who don't get their feelings hurt in arbitration. It's water under the bridge by the time free agency rolls around. In this case, the arguments will be less hurtful, more trying to establish precedent anyways. If the Tigers go in saying "He should make what David Price and Jacob DeGrom made," that's not exactly a slap in the face. Anybody expecting an elite Boras client to re-sign before free agency is fooling themselves anyways.1 point

as someone who manages a lot of people, if i went into an open process like arbitration and said all sorts of things about how they didnt deserve the same salary as x, y, or z, there would be hurt feelings. no matter how much money they made. i know "its a business", but its still hard to hear that your employer doesnt think youre worth what you think youre worth. baseball players arent robots.1 point

have to agree. Pre-arb salaries are by definition completely divorced from any connection to a player's value. It would be an odd player evaluation system that gave them any weight. But then again, what's not odd about the way baseball players are paid? 🙄1 point

Agreed with all of this although with Ivey I think we need to give it more time. He's still clearly hampered by the injury and has done a solid job scoring efficiently despite in limited minutes. Agreed though that Jenkins should be lead PG of the bench, I have a good feeling about him, he knows how to run a team and has scoring ability. Green is an interesting guy. I wish he was a few years younger but he's a guy I'd love to keep around for another few years if possible, he makes a positive contribution every time he comes in and he's a perfect fit for this culture with that dawg mentality. He and Holland are menaces off the bench and, along with Jenkins and Stew, are the driving forces behind arguably the best bench unit in the league.1 point

But the upper levels were littered with injuries last year. It's why the Tigers went so hard for depth at the deadline. It's also why a bunch of free agents were signed as stop gaps. Heck, guys like Watson and Seelinger were such stopgaps, but they realized they may have found something in them. Minor league free agency after the season is pretty common for most AA and AAA pitchers, so the Tigers didn't really have that anomylous of a season in that regard. What really happened is they had a ton of rental pitchers from the deadline who were gone. I also didn't include Codi Heuer here, who was released in September. Released being a procedural thing because he was injured and couldn't be outrighted. They also had six guys they had to protect (and clearly a 7th in Petit they probably should have if they had room) , had 7 guys to activate from the 60-Day IL, and the last two 40 man moves have been contributors off the 2025 team who were not going to clear waivers. You are basically having to lop off a potentially valuable piece every time you sign a Major League free agent right now, so there are diminishing returns. You get some relief in February when you can 60-Day IL Jobe. That is probably your next MLB Free Agent move.1 point

correct, sorry for any confusion. because of the politics, i would be surprised if they didnt charge him at the state level. i dont think much of a lot of state level prosecutors who are elected and i certainly dont think much of keith ellison in minnesota. so i expect them to "do something," no matter how potentially futile it is. with that said, even if it is umtimately futile, he SHOULD be charged by someone, imo. and my armchair legal analysis may not be correct, its quite possible a judge finds that the threat was not reasonable and that he should not have immunity. one can certainly make the argument. and more facts/angles/videos/ may come out showing something different. by all means: charge him. and for god's sake, at least put him on desk duty for a bit.1 point

See, there are facts, and then there hypotheticals that cannot be proven. The facts are that Harris made certain moves, the tigers finished with a certain number wins, and they finished behind Cleveland and ahead of Houston. The effect of moves made and not made is impossible to say, by you, me, or anyone else. It’s also a fact that the front office has more information than fans. That’s not really up for debate. That doesn’t mean that the front office can predict the future. I recall quite a few folks not being happy with the acquisition of Paddack, but I can’t say I remember anyone saying it was going to cost them their division lead.1 point

under fourth amendment case law, whether an officer used unreasonable force is judged by an "objective reaaonableness" standard. in general, it is unreasonable for an officer to kill someone; however, where an officer has probable cause to believe the suspect poses a threat of serious physical harm, either to the officer or others, it is not constitutionally unreasonable to prevent escape by using deadly force. that's the law. does it apply here? up to your interpretation. she accelerates her car directly toward the officer. that's likely enough evidence to give the officer qualified immunity for using deadly force to stop the car. i - like i think almost everyone else on this board - think ICE officers started this, exacerbated it, handled this extremely poorly, and should not have shot her. period. the officer should not have been standing in front of the car and the other officer should not have approached her in such a belligerent manner. to me, ICE caused this. 99% (the other 1% is that she shouldnt have disobeyed the officer, no matter if he was being an ass hole or not). but legally, i think the officer is probably going to be immune from prosecution or liability. my only question is concerning the subsequent shots. the car is past him. does he have reasonable cause to fire two shots into the car at that point? his argument will be that he can use deadly force to stop a fleeing person who is a reasonable threat to others, and that since she drove her car directly at him, that gives him the authority to use such force because she continues to be a threat. i dont know if that argument is a good one or not, but i suspect it likely will be. the "shoot out the tires" argument is a non-entity. you dont shoot out the tires, you ONLY use force if you think your life or the lives of others are threatened. if not, you dont pull the gun at all. you never "shoot out the tires." shoot to kill or dont shoot at all. its different than a pit manuever or putting spikes on the road (and those are constitutionally questionable at this point too).1 point

Years ago I would agree with the "worse than vanilla ice cream" being an insult. But then I had high quality vanilla ice cream and my attitude has changed. Do vanilla right and it's great. Vanilla gelato at Zingerman's in Ann Arbor blows the chocolate away. Sometimes vanilla is good and when you have been casting about in a sea of mediocrity as long as the Giants had, maybe you need the stabilizing effect of a Mike McCarthy to correct things before you go and get the exciting guy. I mean, like Jeff Fisher, you're always probably going to be in the 7-10 win range, hoping for a couple lucky breaks or a perfectly-timed hot streak like they did when they denied the Patriots an undefeated season. I think Mike McDaniel was fired because they have already hired John Harbaugh. Stephen Ross - Michigan connection. Maybe the belief is Harbaugh and Monken can resurrect Tua's career. But if that's the case, you better have a really good back up because that one bad hit is always looming. If he gets another obvious concussion, they can't let him play again.1 point
